Casey Anthony fraud trial may move forward thanks to a little used law
“The prosecutor is surely going to want to try the easiest case first so they get a conviction on the record,” he said. “That way, when they’re prosecuting the defendant, they’re now prosecuting a convicted felon.”
The prosecution will also be able to include more information in the criminal trial if her fraud trial is already on the record.
Of course, the defense doesn’t want this to happen and are pushing to postpone the fraud trial until after the criminal one. They want to make sure the evidence and testimony from the fraud trial can’t come back and bite them in the butt in the murder case.
BUT, because of a seldom used law that was passed in 2005, the prosecution may prevail. That law says that the victim AND the state have the right to a speedy trial in Florida!
And guess what? The prosecutors announced that Amy Huizenga, the fraud victim, and a key witness for the state in the murder trial, WILL invoke that statute in order to force the fraud trial to begin now.
The defense, of course, will counter, but NeJame says it will be tough for them to win this one.
“I think that it may be time to go to trial on the fraud case,” he said.

Well, that’s interesting and good news if it happens! Good for Amy Huizenga! (Maybe Ms. Lyon should get her head out the school books and pay attention to what’s going on in Florida. JMO)
What this really says to me besides the obvious, is that the prosecution is on top of it all and they will be able to go toe to toe against the “Country Club” defense team Jose Baez managed to put together for Casey.
I watched the hearing yesterday with judge and the state and defence.. and I was very pleased to hear this about amy wanting a speedy trial. thanks for bringing me to a clearer understanding of the benefits of this for the prosecution…. Do you sense a plea from the defence?

Mystery…I think Lyons is and has planned to go for a plea from the beginning…I think she is waiting for the Bar’s decision on Baez…with him out of the picture it will be easier for her to convince KC that a plea is the best she can hope for…with Baez still there KC is not going to listen to anyone but him.
For the Prosecution to push for the fraud case to go forward and should it be granted then she(Lyons) will have that also to help convince KC…I think they are lining everything up…and the Defense knows they have the chance of a snowball in hell of getting her(KC)off…and there is more than a 50-50 chance of them coming back with the Death Penalty
I wish we had an email address for Amy so we could send her our support. It cannot be easy to testify against a “friend” so she’s showing a lot of courage. Amy, if you’re reading this, CONGRATULATIONS for doing the right thing, girl! We are behind you 100% ~ not to mention your automatic immunity from CEV. The virus cannot survive honesty.

maxineme–yes, Yes, and YES! That’s what our Ms. Lyon does best–makes a deal so her client isn’t put to death. She considers life in prison a win. (So do I. I would be delighted for Casey Anthony to get life in prison.)

I think you are right on. Baez has been so quiet–I think he knows the bar has something on him and he will be gone soon. Lyon is counting the minutes til he’s gone and good riddance. She WILL go for a plea deal. She’s not stupid and she doesn’t have the blinders on that Baez does.

Is Baez the lawyer for Casey in this fraud/check case? I know there is a different lawyer for her in the civil suit.
I don’t think Casey will ever go for a plea deal…..she’s innocent remember. she’s totally convinced herself of that. I don’t know…..

What decision on Baez? What did I miss? All this news about Michael Jackson has totally interfered with daily info about caylee/casey case..
FYI… the most interesting info i have heard is the casey anthony police interviews – the playlists. they are on youtube. Michelle Murphy & Amys’ are REALLY interesting. they all start out a little slow, but they get good. casey is going to rot! and i’ll bet she will NEVER EVER admit to any of it. which means i doubt anyone will ever know EXACTLY what happend.

Tricia…Baez is being investigated by the Florida Bar on several complaints one being from Judge Strickland himself…it has been a few months now and they should reach a decision any day now…they could suspend him or they could disbar him…being it it taking such a long time it doesn’t look good for Baez…should they disbar him Lyons will take charge…KC at this time listens to Baez…in fact I don’t think the other attorneys visit her…she sees them at the Hearings but not one on one without Baez present…

Hi Jill…I hate to be the one to burst your bubble but I doubt she would be placed in prison on the fraud case even if she was not facing these murder charges…she would be placed in county lock up….so if she is found guilty she will remain in county jail..then the time would count toward whatever time she is given…hope that makes sense?
I doubt she will have the same sort of feelings for Lyons as she has for Baez…it will be a major adjustment…Lyons will hit her with the truth and not sugar coat things..REALITY…that will shock her!!!

Jill, I think Mand is correct. Casey won’t go anywhere until the criminal case no matter the outcome of the fraud case.
