Brad Conway files for deposition postponement in Zenaida Gonzales suit against Casey Anthony

February 25, 2009

As expected, Brad Conway filed a motion that could prevent George and Cindy Anthony from giving depositions in the Zenaida Gonzales civil suit, saying the suit is only an attempt to annoy and embarrass them.

Mr. Conway said George recently attempted to commit suicide and that he and Cindy are getting professional counseling to deal with their grief.  Conway wants the deposition postponed until May when the judge will determine  if there will even be a civil case.  He says Gonzalez’ attorneys are asking for punitive money damages, but that the family has no money.

Lee says he will give his deposition.

read the article below:

Wesh.com

Mr. Conway is not asking that the depositions not happen at all– just that they be postponed until it’s decided if Gonzales will be allowed to go forward with the case.  I can see his point here.  Why put them through the media circus that  Zenaida’s attorneys apparently want their depositions to be(by inviting reporters to watch and cryptically saying  there will be “surprise” questions) when there’s a chance that the case will be thrown out in May? Let them wait, and if it’s determined that her suit has merit, then have them answer the questions.  Is that special treatment?  I don’t know–enlighten me.

It is not special treatment he is seeking but it is kinda of a catch 22. Attorneys and plaintiff are allowed to make factually based allegations and then they are allowed to do discovery to in order to support those allegations and see if there are additional facts out there. The pending Motion to Dismiss, will not be dispositive. At best (to the proponents of the Motion to dismiss,) if the complaint/suit is defective, lacking in a factually based cause of action, then the Court will allow the Plaintiff’s to amend. It is very unlikely the Court will grant an outright dismissal. So , Conway is pushing the can down the road which he is allowed to do, but not indefinitely. They will have to give a deposition one day and quite likely before the criminal trial gets going.

Before I comment let me state for the record: I am not a supporter of the Anthony Family as I think that “denial” is what made this horrible tragedy drag on and on.
That said, I do think that they have a right to grieve. I cannot imagine with all that has and is being discovered day by day that they are in a “normal” frame of mind. Lee Anthony apparently still thinks he calls the shots though. He stated that if he shows up and there is any media he is out of there. I do agree with Conway that I have never seen a case where media was present during deposition and allowed to ask questions. Maybe I am wrong but I cannot recall one. Unfortunately Cindy Anthony put herself into this portion of this saga when she backed her daughter and said Zanny was a real person who watched Caylee. Can’t imagine my mother making that kind of statement if she never knew a nanny.

Thank you for that information. It clears a lot up. And, you were obviously right. The judge granted a postponement only.

I agree they need time to grieve and it looks like the judge is giving them some time to produce what amounts to a doctor’s note.

    Lunatic

As Curious George said, they will have to give their depositions eventually.

At attempt to annoy and embarrass them?

Hmmmm. Isn’t that what they did to this woman from the getgo? How come it’s okay for them to point fingers, accuse and help destroy a persons financial and emotional well being, but then when it comes down to it, they can’t sit down like civilized human beings and answer questions as to WHY they did it?

Go to court and back up your allegations, Anthonys. At least show up and sit on your rears and take the fifth.

Everything these people do makes them look worse and worse. And you’d think that wouldn’t be possible at this point, but they somehow manage it.

    YUCK.

It is exactly what they did, Robin!

I still think they need time to recover, but I also think that when Brad Conway said they were being counseled he might have been “exaggerating” a little. Why didn’t he have the papers showing they were under a doctor’s care with him if that was what his argument was going to be? I wonder if he’s now frantically looking for some doctor to give them a note stating it would be harmful for them to testify. The problem, I think, lies with Cindy. How can she say she never knew this wasn’t the Zanny Casey spoke of when she admitted she had never met, seen a picture, or talked to her?

Good Morning Mystery…I am wondering just when the Anthony’s started getting counseling? They look for every crutch I agree that depos should wait till the judge decides whether this case will go forward or will be thrown out..and why couldn’t Conway say just that and forget all the other crap?? Now I am beginning to wonder about George’s BREAKDOWN?? Is this the crutch he will use each and every time he is asked to answer a question about the case? In hind-sight it could have been a set up for things to come..he did not go to another hospital after being released from the one he was being treated in ..instead he went home and right back into the stress filled environment that put him in his condition and all has been well..then there was the pills he never took..so his call for help was not as urgent as first believed..he had had some beer and was slightly drunk..thus the sloppy writing in the suicide notes and the slurred words..I did feel at the time it was a call for help..but I am beginning to think George is a pretty good con artist..because he shows you his weakness he becomes more believable..unlike Cindy’s in your face brashness…George is sneaky plays both sides of the fence…tells LE one thing then sides with Cindy as tho he never said a word against KC..He has taken up with those of questionable character and is willing to be the front man for this con group..just to many things are coming into question about him..I feel they are both on the same page G&C that is..JMO

Very good points. I won’t believe they are getting counseling until Conway produces the documents.

I don’t know if I think George is sneaky or if he’s just afraid of Cindy. He was truthful with LE and then lied through his teeth on Larry King with Cindy. I tend to think the hospital wouldn’t have kept him that long if they didn’t believe he was in need of help, though. I think George and Cindy are on the same page–just that George isn’t willing to lie to authorities like she is when it comes down to the wire.

Hi Mystery, thank you for the nice compliment on your other blog. My viewpoint is the Anthony’s are going to be in a grieving process for a very very long time, and they still have a daughter in jail facing a murder indictment to deal with as well. That being said, now is as good a time as any to get the deposition over with, if they have nothing to hide then it should not be a big deal for them. Lee is co-operating without being forced too,(which we all know is unusual for him to do), but he is doing so because he knows he is in the clear about any repercussions from answers he may give. He has no known knowledge of this Nanny and has not said so, so nothing to get him screwed up on. I don’t know about Cindy as i have not seen her face since the Memorial myself, but the judge should view the tape of George and attorney Conway, giving an interview with Geraldo just recently. George looked the best i have ever seen him and said he was doing good. They talked a little about casey but mostly to george about going to help in Haleigh Cummings case. So what does that tell you? If George is in good enough shape to do this, he is in good enough shape for a deposition. I say like mystery, perhaps rustling to get a doctor’s excuse. how are they paying a professional anyway. George stated to the police officer at the suicide attempt that he had no money, he was broke. Interesting~~

  11. February 26, 2009 1:41 pm

I agree Lee is still trying to run the show saying if the media is there he is clamming up on his deposition. Boy, this family really seems to think they have special privileges where the law is concerned.

George and Cindy talk out of both sides of their mouths and then people are surprised to learn that some question their honesty! We’ve seen these contradictions (some would say LIES!!!) for months now. It is accurate for me to say I have never been in their shoes and therefore unable to know how I would react but in my life I have known people who have suffered very painful losses, including the loss of their child and none of them turned into liars because of it.

I am puzzled too over George’s suicide attempt. I thought he got himself a case of beer and was just trying to “get away from it all” for a while. In fact, the news I first heard was that is exactly what he said to the police when he opened the motel room door. But within 24-hours he went from “just getting away from it for a while” into a suicide attempt! Was he lying to them when they found him or is he lying to us now? Is lying too strong a word? Maybe ‘confused’ would be more accurate?

The same can be said of Cindy’s shifting realities. Is what she posted on her MySpace page the accurate account of when she found out Casey was pregnant or was it almost the exact opposite and how she described it at Caylee’s memorial? We’re talking about the same woman who insisted that the human decomposition of her granddaughter, the residue and the stench in her daughter’s murder-mobile, was a PIZZA! A pizza with maggots on it. Problem is, maggots don’t form on pizza.

Some other threads on this WordPress blog are just dripping with hypocrisy and bloggers all puffed up with self-importance, defending the Anthonys. And that’s fine for them. But I don’t want to defend them and I think that should be fine too.

Mystery, I would like to say that I am happy to be here on your blog and I’m grateful to be able to comment on the senseless murder of a beautiful little girl which has so outraged the public, and demands justice and as far as I am concerned, a court verdict of Guilty Beyond A Reasonable Doubt.

The pity party for the Anthony’s being too fragile to provide “honest testimony” uh huh, yup that’s the quote. So are they not too fragile to provide dishonest testimony endlessly on the airwaves until those lies were busted with the finding of a skeleton?

So the courts are AGAIN supposed to ignore Florida law but…just for the Anthony’s because they’re so special, doncha’ know!

In all of this, not once has the Anthony legal team(s) nor themselves proffered an apology to the very woman they victimized to white wash their public persona and daughter, Gonzales and her kids whom the Anthony’s – in concert – blamed for the kidnapping….who thanks to them, is unemployed and stuck in a homeless shelter.

If the Anthony’s were as public with their retraction and/or apologies to Gonzales and her family, they wouldn’t need to be sued and deposed in the first place.

Excellent point. The judge should be shown the tape of George as he hogged the cameras in the Haleigh Cummings case. Doesn’t look to me like he was hunkered down and so grief stricken that it would be traumatic for someone to question him.

Yes, it APPEARS that Lee is cooperating but it ain’t Friday yet. We shall see.

    Bees knees

You are so right. Tragedies do not make liars. It may make dishonest people BIGGER liars, but they had to be liars to begin with. That’s JMO.

I, too, have found George’s suicide attempt odd. I think he led his family to believe he might kill himself, but from what the police said when they found him, he was not suicidal. Now, I think that once they got him to the hospital, then perhaps they found some cause for alarm in the things he was saying or doing. I don’t know. Of all the A’s I have the most sympathy for him, BUT, he is also a known liar if we are to believe the stories of his and Cindy’s life together. I have known people like Cindy–one in particular resides smack in the middle of my extended family. So, I can imagine that lying was a self-preservation mechanism with George. That’s the thing about liars–even when they tell the truth it’s hard to believe them.

Bees Knees –I am happy you are here, too, and your views are very welcome.

You have every right in the world to your own opinion of this situation and you are welcome to express that opinion here. We are all entitled to our opinions. We can discuss why we feel the way we do and someone else can express an opposite view if that’s how they feel. We can argue about it, sometimes be influenced by the other person, and sometimes not. Then, we can agree to disagree and move on. No one, and I would hope everyone would agree with me, can slam another person in a personal way if they differ with them and expect it to be okay here or anywhere else on the blogs.

    You said it, Augie.

They’ve never apologized to anyone they’ve slammed that I know of–nor thanked them. TES was out a tremendous amount of money but no thanks from them. LP, in spite of his love affair with media attention, did get their evil daughter out of jail, did put up a reward for Caylee, did search for her, and not a thank you to him either. They threw Jesse Grund under the bus but not an apology out of their mouths to him or his father. If she could have gotten away with it she would have continued to lay blame on Zenaida. The list goes on and on and on. But, by heck, people better take their feelings into account and they expect every courtesy from anyone they come in contact with. Really irks me.

I’m wondering about the cloth laundry bag that was identified in last week’s doc. dump. We aren’t hearing too much about that but in my mind that is very incriminating, isn’t it? I mean it’s better than the garbage bags or the duct tape which the defense says is the most common brand in America. But the laundry bag that was used inside the Anthony’s home was a certain brand. And the brand matched up with the one holding Caylee’s remains. The same brand, same type, size, color cloth bag. We haven’t heard the defense pooh-pooh that bit of evidence, have we?

Mystery..the hospital would have held George for 72 hours due to the suicide notes..and that is what they did..he took no pills just a few beers but they will aid on the side of caution..George is as much a liar as Cindy..that’s why they have managed to stay together all these years..we keep making excuses for George because he is easier to take than Cindy..George is a good con artist..he knows how to play it up to get sympathy..they play off one another..and as you said Mystery..he didn’t look fragile hogging the cameras at the Haleigh head quarters site..he had a job to do for Kid Finders…have they gone back? Guess it wasn’t what they were looking for.JMO

I read an article yesterday that said the defense will probably argue that the laundry bag is a common type and also could be found everywhere–just like they’ll argue that the tape and garbage bag was too common to say it was unique to the Anthony house.

It’s all circumstantial–and if it was just one or two things–maybe coincidental–but everything together–BAD news for Casey.

I’ll be interested to hear what they found on the shoes. Especially the ones that were bagged and in her car.

    You’re right, Mand

Wow–that’s almost too much to get your mind around–thinking that maybe George’s suicide was staged. Why? So he could write a fake suicide note saying he thought his daughter was innocent? So he could garner sympathy? I’m not sure what he could gain from doing something like that. Maybe sympathy from Cindy?
    I don’t know.

They did keep him a lot longer than 72 hour–

The Anthony’s should have been to testify in the Zenaida Gonzales deposition – They were able to plan and participate in the elaborate Caylee Anthony memorial service which shows they were definitely able to answer questions in the deposition – Zenaida needs to have her name cleared so that she can get on with the lives of her and her children AND the Anthony’s need to pay for the defamation words – There is no doubt that the Anthony’s will see book, movie rights, pictures, etc., and become rich and Zenaida should receive a large share of these profits – The anthony’s through Zenaida “under the bus” just as they did Jesse Grund and Amy – The Anthony’s are the greatest of liars – no wonder Casey is incapable of telling the truth –

Those are good points Marilyn. They are supposed to testify before the end of the month or provide a “doctor’s note” as to why they can’t.
