Deputy deposed by Casey Anthony defense team and her newest attorney, Todd Macaluso, faces disciplinary action from the California Bar

Jose Baez and the gang deposed OC Sheriff’s deputy, Richard Cain today about what he did or did not see on Aug 13, when he met Roy Kronk in the woods where Caylee’s body was found to investigate a suspicious bag.    Cain said he saw “trash only” when he was there.  Kronk said Cain didn’t want to investigate because they saw a large snake nearby. “The cop, I would say, was kind of rude to me,” Kronk said.  The OC Sheriff’s Office is currently investigating Cain’s response to the incident.  He has been written up twice before for not investigating thoroughly.

Casey’s defense team hope Cain’s account of what happen will help prove her innocence.  “I think he’s an important witness, so everyone should stay tuned, I guess,” Jose Baez said after Thursday’s court hearing.  He’s hoping to prove that Caylee’s body wasn’t in the woods in August and that he might then be able to prove she couldn’t have put Caylee’s body there becasue she was either in jail or being electronically monitored.

On a different note, the supposed “super attorney” that recently jumped on the Baez Bandwagon, Todd Macaluso, is facing charges from the California Bar Association.  Macaluso is accused of writing bad checks from a client’s account. He misappropriated client funds and misused a client’s trust account. A trust account is set up for an attorney to hold the clients money. After a settlement, the attorney would use the money in the account to cut a check. What Macaluso is accused of is one of the most serious allegations an attorney can face.

Macaluso has made a statement saying the checks were written while he was on leave fo a family death and came about because of an accounting error by his staff.

Let’s see—————-the deputy was written up twice before for not doing what Kronk is saying he wasn’t doing–investigating calls properly.  So, three times he’s been accused of the same thing.  Even though the Sheriff’s office says he was cleared on the other two charges, it sure puts whether or not he did a thorough search for the suspicious bag Roy Kronk found in question.  3 times for the same type of complaint?

The dream team can’t seem to win for losing.  First,  yesterday’s fiasco in court, and now the disciplinary action facing the new kid on the block, Manacluso.  I think we ought to stop calling Casey’s so-called high powered defense team, “The Dream Team”, and start calling them the  “Dumb Ass Team”, or how bout the “Scheme Team”, or better yet, the “Schemin’ Demons”?

    LOL! I love the new names. They do seem to continually shoot themselves in the foot. I was hoping they would get a contempt charge yesterday after the way they behaved in court, but Bee’s pointed out that Bozo is in advanced stages of the virus and LKB is now showing female symptoms. Casey has a deadly affect on those she comes in direct contact with. I hope this is a good indication they will lose.

    Hi Mystery..Can this case get any more bizarre? It should be no surprise that the new kid on the team is of questionable character..I don’t think Dumbo knows any other kind..and no attorney worth any thing would associate with a scumbag like Dumbo..however I do think the bar or whoever is in charge of looking out for clients should be looking at Dumbo and question as to why he surrounds himself and his client with the likes of so many of this kind characters.

    Cain is a disgrace to the seems he does not like to investigate a call or write a report or both..he should be fired..there is no excuse for what he did..and it isn’t just the Anthony case..all complaints have to be checked into..this time he caused a huge problem.

    Hi Mand, you’re right. We shouldn’t be surprised in the least that Baez added this Maca-loser guy to the team. He’s requested to practice law in Florida so he can be on this case–wonder if that charge against him could affect that? Supposedly his specialty is cross examination of “expert” witnesses.

    Hey Mystery! I saw the video on that one with Channel 9 and an expert says that he said on his application to the Florida Bar that he had no prior misconduct or something like that, anyway, they said the fact he didn’t mention this investigation could make it so that he cannot represent her in court, or in other words his app would be denied, then he would be just a consultant. Let’s hope.

    Why would Fl.permit him to practice when this is on going? I would think he should be denied at this time and reviewed again when it has been settled in Calif. They say birds of a feather flock together…Dumbo shows the truth in that saying.
    What is it with all the experts??
    I wonder if they are looking for a butt wiping expert for Dumbo?? I doubt he knows how..well the right way anyway!!!

    Wow, Niecey, He’s a liar, too? I’m so shocked. He must not have realized how closely scrutinized everything is in this case and thought it would slip under the radar. Wrong!

    I have to say, I think Casey looked as prim and sweet as a person could look yesterday. Heck, based on her look in the courtroom, I’d want her to be my mother!! A far cry from what we know she is. Keep that look, Casey. It will provide a major contrast to the party pictures prosecution will present to the jury at trial.

    Casey is immune to the infection, being only a carrier.

    To me she’s looking more and more like Cindy! Won’t she love that?

    I was watching Nancy Grace on ustream just now and there’s a theory some of the viewers (of ustream) were discussing. They say Casey left Caylee asleep, mouth taped, hands bound in the trunk of her car from 8 pm until noon the next day ~ in effect torturing Caylee with the ever rising heat while Casey watched the dvd with her boyfriend.

    Bees Knees–

    I hope that’s not what happened. If it was, I doubt we’ll ever know it. Casey would never admit she did something like that. My hope would be if she put the tape over a live Caylee’s mouth, that she drugged her first, and she never woke up, suffocating in her sleep.

    If what you said is true, would that be considered an accidental death? In theory, it would mean she didn’t really mean to kill her………….

    MacLoser hasn’t made it to the island yet. Hopefully, Florida will kick him back to California.

    Baez probably hired him for some tips on tapping into clients $$ for his future “deals”. This is unbelievable! kick him to the curb, like this case needs any more drama.

    Mystery and Bees…if that were the case it would be in theory an accidental death..but on the other hand the prosecution could argue that she should have known the heat would be a factor and cause the child to dehydrate and could lead to death.Of course that’s just what the defense would say was the accident..she never meant for anything bad to would probably be a pretty good defense but she would have to say she did flies much better than the stupid Zanny story that no one believes.JMO

    Mystery..What makes you think Dumbo doesn’t do a background check? This is exactly what he’s looking for..what in hell would he do with an up-right honest..professional attorney..he couldn’t have that..wouldn’t know what to do with him/her???

    Baez need to do his own work he seems to think things will be handed to him on a silver plater. I was also wondering when does he have time to teach that class at that college?? Shouldnt he be deposing these people which he has alot of them if he wants to get to trial?

    I bet that Macaluso is drowning in a failing practice here, that his home is being foreclosed, or something.

    He’s in this for publicity and financial gain and nothing else. He’s probably got more skeletons in his closet than we can imagine.

    There’s a reason that he popped in out of nowhere.

    But whatever happens, don’t shoot him back to us here! We have enough crappy lawyers in San Diego, we don’t want this one back.

    Mand–I guess she could say she passed out and didn’t wake up til whenever after it got really hot and raced down to get her and found her dead. BUT, drugging her, taping her mouth, etc. would be pretty good fodder for the prosecution, too. She doesn’t deserve to get off on accidental death if she did that to her baby. What she deserves is to spend the rest of her life in shackles in solitary confinement.

    I agree about Baez–an honest attorney would look at the evidence and high-tail it out of there–just like Nejame did.

    Susie I don’t know how he managed to get a job teaching a class in the first place. They said his students were in court during his motion fiasco. Guess he’s teaching them what NOT to do.

    Sophie and Mystery, We don’t want him to stay. Granted I don’t live in that part of Florida, but we don’t need anymore crooks either!
    I do have a nugget for all of you. When a person puts another person’s life at risk intentionally, and it results in their death, that is murder in Florida. It doesn’t matter if they meant to kill them or not. Putting Caylee in a trunk, and bound at that would be murder. Drugging her and putting her in the trunk would be murder. Baez can call it an accident until the cows come home and it won’t fly.

    Good Afternoon Ladies…I know if I had a student in that law school I would encourage them to pull out…it only took Dumbo 8 years to pass the I ask you..what kind of school would hire an idiot like that to teach??Makes me wonder what the rest of the professors are like? Is this the bargain basement of schools so to speak?
    I bet if it be known..T M. knows Gil Cabot? They all seem to tie in one way or other..

    According to info on the Nancy Grace show, there were weeds growing up through the remains of Caylee which would indicate she had been there for sometime. I bet the height of the weeds was measured and the prosecution will have an expert witness to estimate , based on the height of the growth, just how long the body had been there. I haven’t heard it mentioned in this case yet but there is a test that can be done on the insects that prey on dead tissue. They take them and put them in a blender and then perform tests on the liquid for various drugs. Since they “fed” on the body, they absorbed whatever was in that body. I don’t know if coloroform disappears quickly or would be transferred to the insects. That cop should be ashamed he didn’t investigate better. If he had no prior problems, it wouldn’t be so troubling but he did. Who knows when Caylee’s body would have been found if it wasn’t for Kronk.
    niecey456, I think you are absolutely right about it being murder when a person puts another person’s life at risk intentionally, and it results in their death, that is murder in Florida. I think it should be too. That poor baby is just as dead, whether it was intentional or not.

    Mand, they’ve taken “networking” to a new level. I’d bet they all knew each other, too. Or maybe, as a friend of a friend of a friend who was a friend………

    Thecla, You are right, there are all kinds of ways to determine how long those bones were there. Of course, Baez will have expert witnesses saying the prosecution’s expert witness are wrong……

    You know, if Cindy’s “people”, Dominic Casey, and Jim Hoover, had an idea that Caylee was there, I wouldn’t be surprised if they would not have continued to search and eventually have found her remains. Kronk just beat them to it. We all wonder what might have happened if D. Casey found the remains first.

    What is sooo sickening about that is behind the scenes she had them searching for a body, and after the way she treated Tim Miller about that. I have no respect left for her. Talk about a liar. Casey learned from the best.

    The problem with this story is the Deputy never said he saw a snake, or that he wouldn’t investigate because of a snake. KRONK said in his 911 call that HE was not going into the woods again because HE saw a snake. The Deputy was not even aware of it.
    Also, the prior accusations of the Deputy not investigating were dismissed because they were unfounded.
    The biggest problem with this case is that there are so many rumors and misinformation flying around that the media of course always reports as fact. The truth of the matter is, nobody knows what really happened there because we weren’t there. Kronk says one thing, the Deputy says another.
    Personally I think this Kronk guy is extremely shady. If you have heard each of his 911 calls, and what he has said in interviews, you’ll see that he contradicts, makes assumptions and just generally throws out whatever he can to make himself look good.
    As for the Deputy, I don’t think anyone can jump to conclusions with the small pieces of info we hear here and there. It’s like trying to finish a puzzle of a picture you’ve never seen before… only half of the pieces are missing.
    When the internal investigation is over and Deputy Cain can tell us for himself what really happened, I think a lot of the confusion might be cleared up. With another piece of this tragedy’s puzzle, maybe the picture will get a little clearer.
    Then again I could be wrong entirely. The point is I don’t see how we can all jump to conclusions and assume we know what’s going on with any of the characters in this story when we’re only told half-truths by the news.
