Jose Baez will argue for a change of venue late Monday saying Casey can’t get a fair trial where it is currently scheduled to be. He is expected to answer questions from the media according to Marti Mackenzie, his spokesperson.
During NBC’s “Today Show” on Monday, Linda Kenney Baden, another of Casey Anthony’s attorneys, blasted the local media saying, “Every single day, since I’ve been in this case, which is Dec. 11th, there has been a story, a story, a story. Even when there’s a non-story, there’s a story. Baden believes that the local media coverage has “absolutely” tainted the jury pool. Baden said local media uses leaks from questionable sources, including LE that many times turns out to be false. On the other hand, she praised national media, saying they have been completely fair in their coverage. This is why she thinks the trial should be moved. (I’ve gotta say it–I think a whole lot of the stuff being leaked to the media comes directly from the defense!!)
When asked about the recent document release, Baden felt it helped the defense not the prosecution. (So do I. There was really nothing there that would further implicate Casey. The dirt in the trunk did not match dirt from the scene nor did trace soil on the shoes. The duct tape had no fingerprints. These were two key pieces of evidence that could have tied her directly to the scene, and everyone expected them to have some bombshell like that because they asked for the death penalty. Instead, the evidence released did nothing to bolster the prosecution’s case but did raise a lot more questions about what exactly they have that would compel them to raise the stakes.) When Ann Curry, the interviewer, asked if LE was still withholding some sort of bombshell evidence, Baden said the defense is exploring the reasons why the prosecution would now choose to seek the death penalty–including whether it was to get rid of some of the defense team, to get a more sympathetic jury for the prosecution, to appease the masses, or perhaps persuade Casey to take a plea deal.
Baden also parrotted Baez’ claim that Casey partying madly after Caylee was gone was just her unique way of grieving, citing the Cynthia Sommer case.

Obviously this is the direction they are going in explaining Casey’s crazy behavior. Baden also used Susan Smith as an example though I didn’t get the connection there since she DID kill her children and said someone else did it–isn’t that what Casey is doing??? Saying someone else did it?
I still think the prosecution has a really strong case based on circumstantial evidence and Casey’s behavior–not reporting her missing til her mother forced her to, and all the witnesses saying she acted completely normal during that time. I also think her family has helped the prosecution–nobody is looking for the “real murderer.” That says volumes to me. The two so called “PI’s” searching the woods also does nothing for the defense. BUT, that said, it sure would be nice if the prosecutor’s could still pull out a couple of irrefutable facts to implicate Casey Anthony 100% in the murder of her daughter, Caylee.
