Did Baez make a boo-boo in the Casey Anthony case?

Did Jose Baez and Andrea Lyon screw up when they filed their motion to dismiss the murder trial and aggravated child abuse charges against Casey Anthony?  According to Florida attorney, Richard Hornsby, yep, they sure did!  He said that not only does their motion lack substance, it is procedurally incorrect and was filed too late.  He feels certain the state will file a motion to strike. Hornsby said that  Baez should have filed that motion at or right after Casey’s arraignment— a year ago.   He added that he expected more from Casey Anthony’s dream team, but they are not Florida attorneys and are not that familiar with Florida law.

When asked what chance he gave them that Judge Strickland would grant their motions?  NADA. ZERO. NONE.

Those fancy smancy attorneys should have done their homework–but, then, why would they have? They thought they had an “in-house” expert on Florida law.  Their fearless leader,  Jose!  Jose Baez IS a Florida attorney.  He should have known when he had to file that motion!  Bozo made a Boo Boo and our girl, Casey, has to pay for it.

    Mystery~ I read that a while ago about having those charges dismissed. I thought Baez and co. was just hoping or that the judge would agree. I think it should have been done weeks after the initial charge. Can’t believe he did not know that I am not an attorney and found that in the Florida laws. You get what you pay for. Actually Jose had visual aids today of Casey and Caylee so he got paid.

    Defense attorney Richard Hornsby said evidence from her car alone suggests Anthony knows how Caylee died and what happened to her body.

    “Casey never said it was stolen and when she abandoned it and her own parents go find it, there’s smell of death,” Hornsby said.

    Baez said the truth about what happened will come out at trial — if we ever get to that point.

    Laura–It never ceases to amaze me what an incompetent attorney this man is. And someone hired him to teach other would-be lawyers?

    Maybe incompetent is the wrong word–inadequate and uninformed would be better descriptive words….

    “Lacking in substance,” and “They don’t know Florida law very well,” this defense lawyer, Richard Hornsby, says. HA HA HA HA HA!!! I love that clip they use of the glorious defense team! Lyons looks like a great, big, king-size, damp and rumpled bed in need of fresh linens lumbering around in the courtroom. I almost thought I saw the back of her skirt trapped between her huge buttocks when she stood to move towards the bench there at the end, but no such luck. Maybe next time. Heh heh heh . . .

    Sheaffer said those similarities will be obvious to a jury. This evening, Belich reported that the defense “would not respond to anything that hasn’t been entered as evidence in the case.”

    WESH turned to Orlando attorney Richard Hornsby, who has offered legal analysis for the station.

    “Hornsby said evidence from her car alone suggests Casey knows how Caylee died and what happened to her body,” reporter Bob Kealing said.

    Hornsby said: “Casey had the car. She never said it was stolen or anything like that. She abandoned it.” And he added that Anthony’s parents recognized “the smell of death” in the car.

    In another report, Hornsby described Casey’s “incriminating, bizarre” behavior that makes “it obvious she knows something about the post-death issue.”

    Last month, WKMG-Channel 6’s Tony Pipitone reported that the Henkel tape attached to the toddler is a special make and not the best seller that the defense claimed it to be.

    “This specific, industrial, fire-resistant tape is a tiny fraction of all the tape sold by Henkel,” Pipitone said.

    The WFTV report was timely, impressive and attention-getting. Reporter Kathi Belich noted that the defense had tried to dismiss the duct-tape evidence. But she reported that the Henkel duct tape on a Caylee poster had the same distinctive markings — a black oval logo, temperature specifications — as tape found on the child’s remains and on a gas can at the Anthony home.

    WFTV legal analyst Bill Scheaffer asked: “What are the statistical chances that those three pieces of duct tape did not come from the same source roll, that roll belonging to the Anthonys?”

    I saw that Mikka. That tape hasn’t been sold in several years and not all that many rolls made to begin with. 3 pieces of it–2 without doubt associated with the Anthony house. Doesn’t look good, does it—even without the heart residue

    so baez tries to spin doubt on the duct tape, now it turns around right back into a “huge” blow to the defense.! the adding of the 3rd piece on the sign definitely ties them into the anthony home. hahahaha Great work by Belich & news team!! maybe next time evidence comes out, baez will keep quiet! please….

    Unfortunately, the defense attorneys did not make an error.

    Did they make a procedural error? Yes.

    Was the primnary goal of making this slew of motions to have any of them granted? No.

    Was the primary goal to distract public attention from the actual document release and to sway the many casual followers with inaccurate sound bytes and screen time? Yes

    Did the defense succeed? Yes – they have dominated the TV screen since just after the doc dump last week.

    Has the media ensured that both sides of this case are seen fairly and accurately? No – although Kathi Belich (bless her heart) has come out swinging with the duct tape pic and some of the other local stations have pumped up prosecution-friendly coverage, these are local stations that are not seen widely by the casual viewing public. Geraldo and the Today show are seen by millions and no decent rebuttal to Jose’s lies has been shown.

    You’re right Spacely. But it doesn’t matter in the end does it. The truth will prevail and Casey will pay for her crime.
