Did Roy Kronk kill Caylee? The defense says it’s possible in a new memorandum to a motion filed today

Shortly after deposing Roy Kronk, the man who found Caylee’s body, Casey Anthony’s defense team filed another motion.  This one alleges that Roy Kronk could be responsible for Caylee’s death.

Baez filed the motion that for the first time gives a glimpse into the defense’s strategy that someone besides Casey Anthony killed Caylee.  The motion claims that Kronk has a history of abusing and restraining women with duct tape as well as holding them against their will.  It also claims that Kronk has a history of inappropriate behavior with young girls.

The motion states that Kronk, “is involved in an imaginary world of fantasy and violence.” and ends  by stating that,  “Roy M. Kronk should have been a suspect in this case.”

Kronk, said, “I haven’t done anything wrong, and I maintained that all along.”

Baez interviewed two of Kronk’s ex-wives, a live-in girlfriend’s daughter, and his son.  They paint a picture of Kronk as an untrustworthy person who isn’t above resorting to violence.  The ex-wives say Kronk physically attacked them, and one of the women said he held her hostage for two week and that duct tape was used to bind her.  There are no police reports to support these women’s claims.

Kronk’s son Brandon Sparks said his father told him before Thanksgiving 2008 that he found Caylee’s body and would be on television, leading Baez to claim in the motion that Kronk not only knew the location of Caylee’s body in November of 2008, and that he may even have had possession of it.

The defense hired a new member for the A-Team, Mort Smith, a private investigator and professor at DePaul University. (Andrea Lyon’s stomping ground)  He was apparently hired to dig up dirt on Kronk.

Baez says that all the prosecution has is circumstantial evidence against Casey for 1st degree murder and in order for that to stick, all other options must be ruled out according to Florida law.

Kronk’s attorney, David Evans, issued a news release this evening:

“Shortly after adjourning the deposition, the Anthony defense team filed a Motion, Memorandum of Law, and accompanying materials suggesting that Roy Kronk, the individual who found Caylee Anthony’s remains and repeatedly reported his find to law enforcement agencies, should be considered a suspect in the murder of Caylee Anthony,” Evans said. “He voluntarily appeared today and truthfully responded to all questions asked by Anthony’s attorney. He has cooperated fully with law enforcement from Day One. He has nothing to hide, and has hidden nothing.

In their zeal to defend Casey Anthony, defense counsel has filed papers with the Court that are filled with allegations that have no basis in fact and falsely accuse Mr. Kronk of various types of bad behavior,” Evans said. “The State will respond to these papers in due course in the criminal proceedings. As for Mr. Kronk, he vehemently denies the allegations against him and is confident that he will be vindicated. In the meantime, as he stated early on in this case, no good deed goes unpunished.”

    So much for Cindy & George’s softer image! They KNEW what was coming today. I believe that when they said they wanted Kronk to be truthful, what they were intending was he be truthful about his shady past and how that connects to their dead granddaughter. These people make my skin crawl. Since when does a good defense include framing someone innocent? Sadly, filicide is not that rare of a crime ~ keep in mind every time it is committed it leaves another set of grieving grandparents in the exact same position Cindy and George find themselves. Has anyone ever seen this creepy, tacky, slimy behavior from any of them? Right now in America there are 49 women on death row, 11 who killed their own children. Have we heard even one word from those eleven sets of mourning grandparents? How about the ones that are not on death row. Where were Andrea Yates’ parents? How about Susan Smith’s? How about parents of men who kill their children? In my own memory I have not read about any of those grandparents actively looking for so many innocent people to pin it on. Leave it to George & Cindy. They give me the creeping willies!

    This really leaves a nasty taste in my mouth and shows the despicable tactics that Casey Anthony’s defense are capable of. We already knew what the Anthonys were capable of.

    Kronk may or may not have done the things these women claim. There doesn’t appear to be any police reports and I would think if a woman had been held against her will for two weeks and tied up with duct tape she would have called the police when she was released.

    Whatever his past is, saying that he kidnapped Caylee is just a little far-fetched to me. What was his motive? And are they going to say he’s Zanny and he’s responsible for keeping Casey from reporting her daughter missing for 31 days? Was Kronk the one that Casey was protecting her family from?

    Really a stretch, IMO

    Oh, I knew they’d do this to him. They’re just so predictable.

    So, assuming he did it, how did he ‘get’ Caylee in the first place? Casey certainly didn’t mention knowing him, or him taking Caylee from her. She placed blame squarely on someone who didn’t exist. Can Kronk possibly have kidnapped Caylee from the imaginary nanny?

    Come on Defense. Get real. Make the girl cop a plea once and for all.

    Hi girls…..reading this garbage really makes my blood boil…remember Baez wanted Tim Millers records? He only wanted those records to search for ex cons or people with questionable behavior. He is really a slime bag. His only motive right now is to win and be famous. I only hope at trail the prosecution can tell the jury how the defense first tried to blame Zanny, when they couldn’t find her they blamed Jesse, Amy, Ricardo,and Tony. And now Kronk. How sad is this case…. I pray every nite that the FBI has the goods on Casey…And if they do??????? I hope that the defense tries to blame the last two Victims for the motive of this crime…….Guess who?…Your right, its the loving, kind,soft spoken, generous…..LOL…Anthonys….Maybe then they will really feel the wheels of the bus crushing them……..

    I agree–only I don’t believe the defense ever looked for Zanny in the first place. I believe they will try to implicate Cindy or George in the end. I’ve thought that for a while. With all their “half-lies” and out and out contradictions, it won’t be much of a stretch to make them look like possible suspects.

    Molly, OMG, that was hilarious. And, jokes aside, the idea that Kronk, the finder of the body, is the murderer is just plain ridicules. It’s also dangerous that they are accusing him, IMO. What kind of message does that send to “Mr.Average Citizen” that happens upon a crime scene? It says to me, walk on by—don’t get involved. As I recall, Kronk was even concerned about that and tried to remain annonymous on the tip line.

    Mystery, I didn;t mean that the defense would blame George and Cindy for the murder,but that when the prosecution has the goods on Casey.That they will try to blame them for Caseys upbringing and that Casey didnt want Caylee to live the life that she did……You know the spoiled, lazy, selfish unloving, disrespectful biotch that she had become…The defense will try to say Casey was trying to save her…..And if they can sell that…….I need to call them and tell them I have some ocean front propterty in Arizona to sell them…

    I did misunderstand you, lynn. Sorry! I still will not surprise me if they try to say George or Cindy had something to do with Caylee’s death. If they think it will fly to create reasonable doubt, they’ll do it.

    Hi Mystery and everyone, okay i get it, i now see what the Defense is going to use to get their client off, they call it STUPID~~ STUPID, a simple method even a clown can think it up and did however, it means if the Defense/Scream Team are this stupid to try to throw Mr.kronk under the bus, then they surely need meds and straight jacket’s so therefore Casey get’s an Aquittle or Mistrial due to her defense is just plain STUPID.

    Lord, I hope there’s no Acquittal or Mistrial. Stupid? Maybe. Desperate? For sure. Remember they have to come up with something before February!

    Mystery, do you know how old Kronk’s son is? not that it matter’s just curious. His ex wives sound like they have an axe to grind and maybe think they will get some monetary gain out of this possibly and recognition. No way in Haiti’s would i ever buy Kronk was involved and killed Caylee. Anyone that defends G&C has the right too, but God help them as they have no idea who or what these people really are. I hope Kronk ends up rich from being allowed to sue all of this bunch, and leaves nothing but Ant/scream team rubble in his wake~~ Go KRONK, GO CAYLEE~~

I watched one of the women on JVM, I think, and she would avert her eyes as she spoke. Even if he did do even a smidgen of the things they are accusing him of, shame on him, but it has nothing to do with this case. I don’t think it is only fine upstanding citizens with no skeletons in their closets that are the only ones allowed to discover a body.

    ON JVM tonight, Baez was careful to say he wasn’t accusing Kronk of anything, just SUGGESTING that there are other scenarios than just Casey. He no want a defamation suit, and he knows he’s got nuttin’ honey!

    Hi Mystery! OMG!!!!! Bozo gives new meaning to, stupid is as stupid does!!!!lol I read on the WESH link the bumbling rants that Bozo said that he is not saying that Kronk is the one who killed Caylee but that his background should be investigated.Huh????? Well IMO this smells like Bozo is trying very hard that Kronk be seen by the jury as a non credible witness because of the big part he played in finding Caylee. He obviously wants to belittle Kronk in the eyes of the jury so that Kronk will not be looked at in a favorable light. He wants all his past magnified until it overshadowed what KC did. I don’t know what all Kronk has done in the past and frankly I don’t give a flip. I believe as soon as the jury sees Caylee’s skull and bones with the several strips of duct tape on Caylee’s skull and how KC didn’t report her while she partied and crawled into bed with various guys, no amount of what Kronk did what to who, won’t matter in the least! I thought the Anthony’s and Bozo couldn’t stoop any lower but I think we have yet to see the worst of their accusations. Since the deadline ordered from the judge is right around the corner Bozo thinks this is how he is going to hold the judge at bay. I have a feeling this is going to blow up on the Defense’s face big time!!!! Thanks for a great post Mystery!!!

    Hi Nancy! Baez was on JVM last night with that smirky grin saying he’s not saying Kronk did or didn’t do it, but he wants to show there is a possibility that someone else COULD have done it. If Roy Kronk is the best he can come up (I think he will still throw Jesse and Ricardo and possible family members of Casey out there as possible suspects as well) you are right, it won’t convince anyone of anything.

    Short of coming up with Zanny, it’s all pointless— but necessary. They HAVE to create reasonable doubt–I just don’t think they can. I agree, Casey made sure of that with her own blatant actions. Dead body in the trunk, party time, theft, lies to police, and the fact that she didn’t report Caylee gone til’ her mother forced her to, leaves little for the defense to work with.

    I agree 100%, who cares what Kronk did in the past or what his bitter ex-wives say to exact revenge on him for whatever they think he did to them in the past.

    Good Morning Mystery and All!

    I would like to say I am shocked, but really very little shocks me in this case anymore. They have been trying for some time to point the finger at Kronk. In hearing his sons statement do I think that Kronk could have said this? Sure, but we are talking about November when he had been trying to report this for months.

    George and Cindy knew exactly what this angle is and as much as they cry for their daughter being prosecuted in themedia it is exactly what they are all doing to Kronk. Potential jurors can now have another angle to maybe think of and then perhaps that will put “reasonable doubt” out the window.

    Sadly, this man has endured so much stress, lost his job, and has had fingers pointed at him from every direction. All for trying to do the right thing. More sadly, this could be a lesson to future cases and could prevent someone from coming forward.

    Regardless of what happened in Kronks past, he isn’t a convicted child molester, rapist, murderer or anything alike. Casey Anthony found her scapegoat and the defense will run this to the ground. Of course then when that proves false they will move on to another. I wonder if George and Cindy have a clue that if this doesn’t pan out, they could be the next ones the defense looks at?

    The son’s statement to me, is much more important than what 2 wives out for possible revenge might say. That statement, taken out of context, does sound suspicious, but give what we know about his previous calls and attempts to get LE to check out the bag, it really doesn’t mean anything.

    It’s hard enough now to get people to step up and help a victim or step forward and report a crime. No one wants to get involved for fear of facing repercussions or being put under a microscope, and Baez’ attempt to blame the messenger shows there is some validity to their fears.

    There is more evidence fingering George and Cindy as murderers here than Kronk.
    **I’m not saying they did it.***

    But if this is what the defense would do to Kronk, think what they could do to the Anthonys. The car is in the parents names, they do have access to keys, the cleaning could be seen as covering for themselves, the duct tape, the other items from the house, Cindy’s admission of looking up chloroform, their debt, unhappy marriage, etc. Cindy’s July 3 entry of missing Caylee could be strewn as a confession of murder.

    Kronk’s past relationships sound sick…if they are true. I don’t know why these women would lie (but I know why Mort would.) A lot of women don’t file police reports. Anyhow, if this can of worms is opened, I’m sure the state can deal with it. Mort will be exposed for what he’s done, and Baez will again look foolish. Just doing his job.

    Ideas–You are exactly right about the Anthonys could easily be made to look guilty–Cindy has, in attempt to cover up and lie for her daughter, has effectively set her own self up. Kronk does sound like a guy with problems (that’s an understatement if the wive’s stories are true–which I question)but it has nothing to do with the Caylee Anthony murder case.

    Not content with the findings of Dom Casey and Cindy the defense have hired Mort Smith {PI} who hails from the stomping grounds of Ms Lyons…Illinois.

    I do not think for one minute that Baez expects to use this as his defense. This will only be used to prove Macaloser sworn statement that they know some one else did it.

    Valhall’s summary saved my sanity and bolstered my above thoughts.

    I totally agree with Halfpint and many others who feel that Roy has been thrown under the bus by 👿 Baez. How low can he sink?

    Well, they tried and couldn’t blame Jesse Grund for it all, so now they’ve found someone else.
    Are you for real Baez? This accusation just brings up more questions.
    Where and how did Roy Kronk meet Casey and Caylee?
    Why did Casey give her daughter to him, or did he kidnap Caylee?
    Why didn’t Casey go to police if he kidnapped Caylee?
    Did he also steal her car for days with Caylee in the trunk?
    Is he the one that grabbed Caylee in Blanchard Park?
    Did he hand Casey a 30 day script?
    Did Roy Kronk have a key to the Anthony’s home to steal Caylee’s blanket and duct tape?
    Did he give Casey back her car after 3 days, so she could abandon it at Amscot?
    Is he the “real” zaneida?
    How dumb do they think we are?
    Everything points to Casey and they know it.
    I have 2 questions for George and Cindy-
    Would you really want to send an innocent man to prison to get guilty Casey off? Is that justice for Caylee?
    I wonder what Caylee thinks of her grandparents now, when she looks down on them from Heaven?

    As Baez said on JVM–they are trying to create reasonable doubt. It’s possible that Kronk did it. I’ts possible that other people did it—-but, IMO, not reasonable.

    Would the Anthonys want to send someone innocent to jail to get Casey off? IDK, but it sure seems like it!

    This motion is yet another legal waste of time designed to grab headlines and possibly plant seeds of doubt in potential jurors.

    I am confident that the police investigated Kronk way back in Dec 2008. Up until now, there has been no reason to disclose any of that investigation as part of the docudumps because none of that would be used by the prosecution in trial because that investigation led nowhere. So, this may be a tricky legal way of getting nasty information published about Kronk in the media because the prosecution may be forced to release details of the investigation showing he is cleared, which will create more media focus on Kronk and away from KC.

    A dead body in the trunk of KC’s car may be circumstancial evidence, but it is strong circumstancial evidence. Going to be hard to dismiss that kind of thing with a man not tied in any way to that car.

    The plant and insect evidence from the scene also seems to conclusively prove the body was in that location since late June, so claims of possession of remains directly contradict forensic evidence.

    JVM brought up the fact that none of this may be admissable in court, and Baez agreed. You are exactly right, Spacely. This is just a diversion. The entomology reports are pretty powerful. When the defense got those reports, they should have immediately changed tactics and started working on a plea deal for Casey.

    Baez said on JVM that Casey deserves her day in court—whatever! Wht Casey deserves is a defense that has HER best interests at heart, not their own.

    This is the most disgusting thing yet. How much more poison can the Anthonys and those attorneys spew? They have tried to implicate everyone in this case. Everyone ever involved with the Anthonys are going to be covered in their filthy business by the end of this trial.
    As Kronk says “no good deed goes unpunished”. I have never seen the likes of it in all my years following true crime. Despicable isnt even a good enough word for what they are doing. I wish I could remember
    what Leonard Padilla said about the “daisy chain” leading to Kronk.
    Not that Kronk had anything to do with killed Caylee, but that there
    was some kind of tip off to Kronk of where the body was. Does anyone remember this?

    Something about a girlfriend of his worked for the police dept or something like that. I have a hard time buying into any kind of conspiracy, but anything’s possible with this bunch.

    “The state of Florida has a duty to investigate every resident of the United States of America and rule them out before they can accuse my client of wrong-doing.”

    WFTV legal expert Bill Scheaffer says this is a low blow by Baez, who appears lost in his own case.

    “The defense has continued to have a suspect de jour other than Casey Anthony,” said Scheaffer.

    The accusation came after depositions Thursday in the form of a motion to introduce “bad acts.

    “This is beyond a pathetic attempt, this is a despicable act on the part of the defense in this case,” said Scheaffer.

    I guess desperation calls for desperate measures.

    Hi ya Mystery. They are saying there is as much circumstantial evidence against Roy Kronk as there is against their client. So I am assuming that there will be 10,000 plus pages of circumstantial evidence turned over to the state. On the Today show, Baez said he is bringing it to the attention of the court. I think he is bringing this to the attention of the public. I think there is a different way to get this to the courts besides all the talk shows. They really need to zip it! 😉

    On JVM he said it may very well not make it to court. (translation: it’s a crock of bull and it won’t make it to court.) But, it will punish Kronk for finding Caylee by revealing every sordid detail of his life in a public forum. Horrific message to send to any potential witness teetering on the edge on whether to come forward or not in any type of case.

    Spacely, ROTFL!!! 🙂 in the event the Easter Bunny gets cleared, they’ll move on to framing the white rabbit from Wonderland, and call Echo and the Bunnymen to the stand to testify that the lyrics from their song “Killing Moon” were inspired by the white rabbit’s crimes against the Anthonys. They’ll even perform the song in court, and give Jose the opportunity to perform an interpretive dance…. Case closed…..

    On WFTV-Channel 9, Daralene Jones said Kronk “is being picked apart by Casey Anthony’s legal team.” WFTV replayed part of Lyon’s interview with NBC’s “Today.”

    In a report last night, WFTV legal analyst Bill Sheaffer described the motion as “beyond a pathetic attempt — this is a despicable act on the part of the defense in this case.” Sheaffer said nothing connects Kronk to the Anthony family before he found the child’s remains.

    WESH-Channel 2 plays snippets of Lyon and fellow attorney Jose Baez on “Today.” WESH also interviewed David Evans, Kronk’s attorney, who said the defense had built its motion on comments by Kronk’s estranged family.

    “It was calculated to deflect attention away from Miss Anthony and over to Mr. Kronk,” Evans said.

    In another WESH report, Evans said, “They’ve dumped a big pot of mud over his head and said, ‘Look at this guy.’ ” Evans said his client had become a witness and a victim.

    Evans told WKMG, “Roy is the guy that has been selected, apparently, by the defense to be the guy to be dumped on, and they dumped on him big time.”

    In a report last night, WESH anchor Martha Sugalski said the station had talked to Baez. “He claims he’s not saying Kronk is the killer but does call Kronk’s testimony questionable and says his background should be investigated,” Sugalski said.

    Yeah, and he said it with that chit-eating grin of his cuz’ he knows he caused Kronk some personal damage, but he hasn’t changed any minds about who killed Caylee. And “It’s All About Me!” Baez has once again made himself the center of attention and the man of the moment in the national media again.

    The white rabbit from Wonderland is an obvious culprit. There is even more circumstancial evidence against him than KC and Kronk put together.

    Why exactly is he always “late for an important date”? Running behind after disposing of a body, perhaps? Or too busy planting false text messages on KC’s account about dead squirrels? Or is he late to a meeting with the pizza delivery kid seeing as he called in an order using the neighbor’s address and plans to steal the other pizzas on the passenger seat to place in someone’s trunk to rot?

    And what about this gang of ruffians he is always hanging out with, the Tweedles? Anyone with a brain in their head can easily see that Tweedle-dum and Tweedle-dee are into all kinds of molestation activities, hence all the tweedling.

    Don’t even get me started on the Queen of Hearts. She proclaimed her guilt by crying, “Off with her head”.

    I don’t think Roy Kronk is guilty of doing the things that these people have accused him of. for all we know, Jose could have paid these people to say these things after his goon squad found them. its not above him to do something like that (ie) bank of America. this is as dirty tatic and I hope the judge will deny this motion. HOW CAN THEY GET AWAY FROM CASEY’S ZANNY THE NANNY STATEMENT TO LE? THIS IS VERY SHAMEFUL AND THE DEFENSE ALONG WITH THE ANTHONYS SHOULD HANG THEIR HEADS IN SHAME AFTER THIS ONE.

    I watched the rerun of JVM’s “interview” with Baez. He and Casey (and maybe G and C) are the only people who could take 5 minutes to answer a simple question without actually answering, and without actually saying much at all. ROTFLMAO!! I can’t even look at him without bursting into the giggles, he’s just that absurd. He looks more like Humpty Dumpty in an oversize suit each time I see him!

    Some of the more memorable highlights:

    JVM: Have you ever cried about this case?

    Baez: …There isn’t a prosecutor alive who could make me cry about this case….


    Baez: I learned a long time ago that you just can’t take yourself seriously with a case like this.

    Had company tonight so I am up late. Earlier, I clicked on Dateline, MSNBC. Anyway, they have a video about Edward Toth who is a child predator. He is on the loose, and the video shows his face clearly. The FBI agent that MSNBC is talking to said he is very, very, dangerous, and very cunning. He has worked as a teacher, and a tutor, and is very persuasive. I do hope u will watch the video, and hopefully be able to “freeze it” to get his photo. It just may save a child’s life if parents and teacher see it. Many Thanks, Hadley (Wish I had your skills with computers!! I’m lucky to get an e-mail through! )

    Argentina Rose—I guess the defense has “discarded” the Zanny theory so we should just discard it, too. Another of Casey’s half-truths. If, as Cindy said, there is a little truth in all of Casey’s lies, please explain to me where Roy Kronk fits into that scenario?

    Mystery, he dosen’t fit into this case and thats the reason judge Strickland will deny this motion as well he should. they have tried as hard as they could to pin this murder on everybody except the one who actually committed it. and as for C&G, they are just as dirty now as they were before they were rebaptised. they were just trying to wash their SINS away only to commit more. GOD don’t like ugly and he sure isn’t liking them and what they are doing right now. they know and have known for a LONG TIME THAT CASEY KILLED CAYLEE AND THEN AGAIN, I KIND OF THINK CINDY HAD SOMETHING TO DO WITH THIS MURDER. I THINK WHAT EVER HAPPENED TO HER, HAPPENED IN THAT HOUSE ON THAT SUNDAY NIGHT.just take a look at Cindy in the video at one of the JAIL HOUSE visits where Cindy is acting like a CAT ON A HOT TIN ROOF. its the one where some people tell others to turn off the volume and take note of her body language during this visit. something is just not right here.

    ArgentinaRose–If they do go after George and Cindy, I think it will definitely be AFTER Casey’s trial, not before it. I think it was Bill Sheaffer that said they could plead the 5th in Casey’s trial if there were charges against them.

    How does Kronk fit into the Zanny defense?!?

    Have you ever seen Kronk all dolled up in a long black wig and a tight dress?!? I am telling you, the guy is a 10!!!

    This also explains why KC was unable to overpower Zanny at Blanchard Park… she was not expecting the strength and fitness of a county water meter reader…

    … and once, for Christmas, Kronk asked for two special gifts: a fern and e-z plant feeding kit… fern and e-z… FERNANDEZ!!!!!

    … he and the other meter readers also had special radio code terms for doing your business in the woods… Gones All to Trees… Gones All Trees… GONZALES!!!!!

    Here’s the problem with Roy Kronk’s son. He is ESTRANGED from his father. Who knows if what he is claiming is the truth? I think Baez’ story that Kronk found the body, squirreled it away somewhere and then plopped it down where it was later found–by him–is ridicules.


    I have no idea if Roy Kronk chews tobacco or not.

    The defense is simply raising reasonable doubt with the jury. Remember, the prosecution will have to prove every element of the crime…mens rea, actus reus, concurrence, causation, and harm…every element. Plus, the jury have to be UNANIMOUS in finding her guilty..not 10-2, or 9-3….12-0 is the one and only standard. The defense just needs to convince ONE juror…ONE! Also, if defense wins…that’s it! No appeals…NONE. Prosecution gets one bite at the apple….
