Judge Blevin Perry and the newest motions filed by Casey Anthony’s defense

Here’s the links to the motions filed by the defense on Monday–the same day that Judge Strickland stepped down.  I gotta tell ya, I’m really looking forward to the hearing that will address these new motions with Judge Blevin “Don’t Try To Play Me Cuz’ You Can’t” Perry.  This man is known for handling difficult cases, is a former prosecutor, has tried numerous homicide and death penalty cases over the course of his career, and his been the chief  judge since 2001.  He is NOT the kind of guy that will put up with any shenanigans in his courtroom.  Can we hear an “Oops” from the defense?


Motion to Declare Florida Statute Unconstitutional LINK

The defense asks that the Judge declare the death penalty in this case unconstitutional.  And, they reserve (respectfully) the right to bring this up again at trial if he doesn’t declare it unconstitutional…….

Gender Bias Motion LINK

Says the judge has the authority to intervene if the State’s decision to seek the death penalty is driven by an impermissible motive–namely, there’s not enough evidence, and there is a bias against women murderers. The State is using that bias to deflect attention away from the fact that they just don’t have sufficient evidence. PLUS, the defense has diligently worked to uncover evidence that  they managed to find without having access to the State’s extensive resources. (patting selves on back)  They want the State to have the burden of proving they aren’t seeking the death penalty because of impermissible motives.

and last but not least,

2nd Motion to Preclude Death Penalty LINK

This one basically says that the prosecution is trying to prevent the exercise of the defendant’s constitutional rights.  The prosecution changed the punishment they were seeking from a non-death penalty case to a death penalty case 4 months after Caylee’s remains were found.  They did this in spite of the fact that they knew Casey Anthony didn’t have the money to fund the more expensive death penalty defense.  The defense wants an in camera sealed hearing in order to give additional evidence to the judge to support their motion.


This stuff is exactly what I would hope that the Honorable Judge Perry would put an end to.  It’s a mystery to me why the defense, who by all accounts has a butt load of work to do before trial, would fritter away their resources on stuff  like this.  Not only does it waste their time,  it wastes the court’s time and could cause a whole lotta work for the prosecution, who , according to these motions, will have the burden of proof.  It’s almost as if Lyons gave her students a graded assignment to come up with ideas for motions, and as a reward she filed every last one of them right down to the most ridiculous.  Kind of like throwin’ a group of people’s chit at the wall to see who’s sticks (an “A”) who’s partially sticks (a “B”), who’s sorta almost sticks (a “C”)  Who’s leaves brown stains (a “D”) and who’s can’t even draw flies (an “F”).

    Hi It’s a and all. Now, aren’t these motions wrong, again, since they are addressed to Judge Strickland presiding? Proof read anyone? Geez, can’t they get anything right? Lyons motions are just ridiculous dragging every court hearing under the sun in with these. Blah, blah, blah. She forgot to add my hearing with the dog catcher a few years ago!

    Ms. Lyon is known for filing lots of Motions and we know she is against the DP.
    The Reason given by the Defense that the DP was put back on the Table after four Month was that the State knew Casey Anthony couldn’t afford an expensive DP Trial. Where in the World they come up with such a Non Sense? It is like little Kids playing silly Games and not like a Dream Team of Attorney’s who should be getting on with this Case and stop All that Non Sense!
    I am sure the State has more important Things to do than trying to think how they can stick it to Casey A.
    The DP is back on as we all know because the Remains of Caylee were finally found back on Dec. 11 of 2008. I wish the Defense quit whining and stick to the Facts instead of making up their own Stories which I might add are very hard to believe and swallow.
    It should be interesting how this new Judge will handle the Defense’s constant complaining and whining without any Merit whatsoever. The Defense is always complaining about the Costs, well maybe they need to waste so much of precious Time and finally get to Work on this Case! JMO
    Does Casey A. think by any Chance just because she is running out of Money or already has that she can get away with Murder, I don’t think so!
    A Child Caylee Marie Anthony was murdered of the tender Age of little over 2 Yrs old,that is a Fact and the Person who did this has to pay eventually and that is a Fact!
    If I would be Casey I would be pretty upset to sit in Jail over 2 Yrs now going on to 3 and no End in Sight, after All according to her she is so innocent!, Hm, that sure is something to think about, don’t you think!

    maybe in the future we should ask a defendant who is eligable for the dp if they have any money. if they don’t then we should just give them lwop.NOT! kc should have thought about that on june 16th, 2008.

    Carol–Lol. They were filed the same day as Judge Strickland recused himself. Guess they didn’t want to take the time and go back and change them–and perhaps they were betting Judge Strickland would still be the judge. They couldn’t have known whether or not he would take himself off the case. But, yeah.

    It is like a bunch of kids bickering and whining on the playground, isn’t it? Hopefully the new “teacher” will get them all under control.

    I also think that now that the State of Florida is the defense’s employer, they better start giving a little thought to their budget and what they are spending the good people of Florida’s money on.

    I agree. If I were Casey Anthony I would spend more time worrying about my future instead of passing notes to her new found friends in jail. This isn’t a game, sister!

    Hi Mystery and everyone here, well what can i say? we are still after all this time dealing with clowns still and obviously they are never going to be beyond clowns so what really needs to happen is the defense team needs to be thrown off the case if that could legally be done and a new mature defense team instated. Bozo is still whining about his client doesn’t have the money for the prosecution to continue on with the DP part, how much sense does that make since she has been declared indigent and won that case so she want be paying for it now anyway. I had and have the utmost respect for J.S. and i really like him and as bad as i hate how he soooooo unfairly with no merit to do so, got bamboozled off this case i believe he was too nice a judge for dealing with Bozo and crew, so i hope Honorable Judge Perry will be a force for the defense team to reckon with. Bozo was paid enough money by his client to get enough done for this case to have gone to triall at least by fall of this year. Bozo whittled it away doing nothing but filing ridiculous motions as he is still trying to do and just about the time J.S. reigned their butts in to dates for him to get it done they pull this crap to get rid of him. It is waaaaaaaaaaaay past time the defense got their non reality butts kicked to the curb. I am cheering on our new Honorable Judge Perry to do just that~~

    Motion 1 – I don’t think this will even get a 2 minutes of court time. Could the statute be unconstitutional? Maybe. But it won’t get decided in a pre-trial hearing. Can they bring it back up in court at trial? Sure, but it still won’t be unconstitutional at that time, so the trial will not be stopped. Can they use it for an appeal? Of course, and I am sure they will. But the bottom line is that unless the statute is declared unconstitutional by a higher court (most likely the Florida Supreme Court), it remains constitutional so the process continues despite defense objections. It’s exactly like the new healthcare law requiring us all to purchase insurance or pay a penalty. Unconstitutional? Technically, no – because in order for something to be unconstitutional it has to be declared unconstitutional by the courts. Therefore, until a court decision is made, it is both constitutional and legal to require us all to follow the law as passed by our elected officials by due process within our legislative system.

    Motion 2 – I believe this falls under the same category as a previous motion where Strickland ruled that you cannot attribute (I cannot remember his exact terms) illegal motives to the prosecution. I believe the gist was that the prosecution is representing the state and, at least during the course of the trial, nothing they do is for any gain other than the quest for justice. Would this be yet another appeal? Sure.

    Motion 3 – Again falls under the same category – Jose is trying to attribute questionable motives to the prosecution. I don’t think this will motion will be granted, but even if it were to get to the point that the prosecution had to defend themselves, I think it will be pretty easy to point to the timeline as expressed in the defense motion and state that timeline is exactly the reason they asked for the death penalty at that time. Caylee’s remains were discovered – testing began – testing took a long time – results were coming back – each result seemed to strengthen the case of the state – they waited for all testing to be completed – they took time to throroughly review all results, possibly even consulting with experts – they reviewed past case law and related legal matters to determine how best to use the new evidence – they eventually came to the conclusion they now had enough evidence to request the death penalty – 4 months seems like barely enough time for that as Jose is claiming it takes so much of his time to deal with this case he can’t even bring in any more business.

    And what does it matter if the state knew KC’s finances or not? They knew way back at the beginning she was a deadbeat and asked for the death penalty then. How does her coming into money or their knowledge of that change anything? Nothing they do could possibly remove Jose from the case, so what was there for the state to gain? Even if they had not asked for the death penalty, she would still have spent all the money as she has paid for nothing at this point except Jose and “experts” which would have all been needed even for a LWOP trial. The only expenses she has incurred are those for Lyon, which were pretty low and probably would have been paid to another attorney anyway if Lyone had not been brought onboard. If the experts are working for crates of oranges, how could any financial strategies by the state possibly work?


    thanks for your clear level headed breakdown of the motions. I agree 100%. Theses motions are re-hashes of previous motions(well, except for idiotic idea of gender bias–that’s a new one. 🙄 all geared towards future appeals. Does that mean the defense is pretty certain they are going to need to file appeals or are they just taking precautions….?

    Well said, Knight owl. And I agree with you about Judge Strickland. He was and is a wonderful fair judge, but the defense took advantage of that. I’m sure Judge Strickland is relieved to be rid of what was becoming an albatrose around his neck. I’m thinking the defense will be wishing their motion hadn’t backfired and Judge Strickland was still there once they have a few dealings with Judge Perry! 😆

    Why didn’t Baez have KC declared indigent from day one? When he walked in the jail that first day to meet with KC she had no job that she was being kept from and had not had one for several years yet he agreed to take the case…true no DP on the table but the child had been missing for quite some time and there was a chance the child would be found dead but that didn’t deter him.
    He was well aware if he played his cards right his friends…like T.Black and the rest could help him get rights payments interviews etc.and the money would roll in. Yet he goes through that like a drunken sailor…paid himself??? Then when the other money dries up has her declared indigent…there should be a way to call him on that!!
    You don’t have to be a rocket scientist to see that was what he had planned.

    I do hope this new Judge stops this SH*T from Baez and the rest of the slime crew…it’s time the stupid games STOP…JMO.

    I am seeing rumors on other blogs that these motions were not filed with the court.

    Apparently, motions were provided to MEDIA, but not actually filed, with some saying the motions are not in the correct format or complete as of today.

    Mystery, do you know if they were actually filed?

    This could be the trickiest piece of defense media propoganda yet. Or, I could be fooled by internet rumors…


    I’m wondering, too. As of yesterday they weren’t on the Court Clerk’s site. Is this an example of trickery and treachery? It really would be a jaw dropper if it was just propaganda.

    Thanks Mystery. You got it so right. Yes our Honorable nice Judge Strickland was definitely taken advantage of by the Defense and he did dot deserve that. Like you i hope they regret it. I have to wonder if Bozo didn’t do this nasty tactic to J.S. to get revenge after he got brought up by J.S. to the Florida bar, nevermind the Judge had too lawfully do it to him, that doesn’t count when your a dirty player like bozo is, so i am wondering if Bozo thought he would just accomplish embarrassing J.S. and gets his digs in yet J.S. would not recuse himself of the case. I mean no Judge will be fairer to them than Honorable Judge Strickland was so it is food to think on for me.

    Interesting thought, knight owl. I wouldn’t be a bit surprised if he had his eye on revenge–but, like you, I wonder if this was really how he saw the outcome of his motion. Things happen for a reason, IMO. Judge Strickland will go on to better things, and Judge Perry will keep this case headed toward the finish line.

    It took 8 years for the bar to let him in…it was his shady personal dealings that prevented him the admission.Owing large amounts of money and not attempting to pay as well as back child support just to name a some.

    Baez was an ambulance chaser…he didn’t have that many clients
    busting down the door for his expertise and knowledge of the law. Hispanics due to him speaking the language others because he was cheap.
    The Anthony case was his hope for a ticket to fame. Other than filing a motion…and he’s still learning…he doesn’t know his A$$ from a hole in the ground…his reason for getting LKB..Lyons…and the rest!!JMO…..

    Great minds think alike, girlfriend! See my response to your first comment above. He definitely saw this as a ticket to fame and fortune. I wonder if he still does cuz’ I’m seeing him as being more infamous than famous, and I’m also not seeing a lot of cash going into his coffers.

He is not going to waste the courts time or money with this stupid crap. I’m sure they haven’t even started on the 100 depos yet…the Judge isn’t going to like that either! The whole defense team is lazy, greedy and pathetic!

    I’m fine. Enjoying this beautiful spring weather. I planted a few tomatoes yesterday. Pollen is every where here…even my Yorkie has allergies.

    So sad about Judge Strickland; but think this greedy, lazy defense will finally have to get off their dead azzes and get some work done!! Chief Judge Perry is going to be ALOT tougher than Judge Strickland! I’m happy for that! I think the Ants are also running scared…haven’t seen them in the media lately…wonder why?     Mystery, April 30! Wow, that shows he’s ready to get this show on the road! This makes me so happy! They are going to regret how chitty they treated Judge Strickland! Bet they had no idea that they would get Chief Judge Perry!! hahaha Oh, this is going to be so interesting to watch! I just hope that it will be televised! ( I think my keyboard is conking out…need to replace it soon!)

    My grandson has allergies right now, too. He and I both have constant runny noses! Taking him to the doctor this afternoon to make sure allergies is all his is….

    Hello to all. Well, isn’t this turning out to be a dandy day? Happy Earth Day. Started right here in good old WI. forty years ago. I remember they were giving out little trees and wildflower seeds for everyone to plant that day.

    Perry asked attorneys from both sides to come prepared to:

    Discuss discovery and scheduling deadlines.

    Discuss future motion deadlines.

    Discuss motions that are still pending.

    The order reflects Perry’s reputation for efficiency. He also asked attorneys to provide him a list of motions that will require evidentiary hearings and those based on pleadings and to give courtesy copies to the court of future motions.

    The motion that defense attorneys filed asking that Strickland be removed from the case was not provided to the court ahead of time, court administrators said.

    Perry also put attorneys on notice about how their behavior in court: He asked that they “familiarize themselves with the Ninth Judicial Circuit Courtroom Decorum Policy” and follow it “at all times.”

    The defense won’t know what hit them! Life just got a whole lot harder for the Dream Team. Classic example of be careful what you wish for!

    This Judge is going to be great! Bozo better get a new suit, he is getting fat. This is going to kill him to have to act and behave correctly! HA! Mason will have to get new batteries for his hearing aide. The rules said something about not repeating the answer. I hope that smirky smiley face is wiped off the murderer too.     Besides getting into trouble over the past couple days I haven’t been paying a lot of attention but I think I heard somewhere there were more docs coming our way this week? So, tomorrow then, Friday’s always been their day! I’m ready for them!

    I’m wondering if Bozo will finally have to sit down and shut up and let the big boys play while he babysits “his girl?”

    I think Baez will finally fade into the background a little now with No-nonsense Perry in charge. Unfortunately, I imagine Cheney Mason will be taking his place in the limelight.

    The motions are still not listed on the clerk of courts site as of today at 4:30 pm – leaving a mere thirty minutes today to file…

    Why would Jose give copies of motions to the MEDIA prior to filing? Is that not the definition of courting the media?

    Or did the change in judge throw the defense for such a loop that they gave this info out to the press before realizing it was time for a major change in strategy?

    Where is the follow-up interview? Why distribute these motions to the press, then dissappear back under the rock we all keep wishing they would stay under?

    Is it really bias against KC to say that Jose is an idiot? Is it not more biased against KC that Jose really is an idiot?

    Is Mason’s brain in a jar of the same name? Is Lyon living up her name by lyin’ to all of us?

    LOL. Inquiring minds want to know…….

    Seriously, does this mean these motions are not going to be filed and were never intended to be filed???

    If Anthony is found guilty in what’s called the “penalty phase,” Luka, who is now a defense attorney, said it would be the jury’s job to weigh the amount of aggravating evidence in the crime versus what mitigating factors Anthony’s defense presents.

    “Normally the biggest mitigation is the remorse factor,” Luka said.

    Yeah, it will be really difficult for the defense to get across to a jury that Casey has any remorse about anything. She will not be a sympathetic figure.

    mikka! you are a sweetiepie, luvuh. I am fine. I will be happy to see this new Judge in action. I love Strickland but not with this Defense Team. It was never going to work. Finally Bozo will have to smarten up!

    I agree that Strickland was not the judge to try this case. I love him, too, but someone with an iron fist needs to deal with this cast of characters–I’m pretty sure that’s exactly what the new judge has–an iron fist.

    Hi all and Bees. Don’t worry about a thing any more. It’s all used air blowing. I am just wondering who the ‘Thanks Carol’ is on his post? I don’t think it’s me. He may be thanking me for the use of my idea of the ‘pass go and recieve $200.00’ card with Casey’s face on it, on his post. It’s all water under the bridge. We have new docs and hearings to look at now.

    I think Perry is outraged at the sneaky, shabby, underhanded way the defense treated Judge Strickland…

    Don’t know if it’s outrage, but he certainly made a point to lay down some ground rules and I’m willing to bet he will make sure those rules are followed.
